This Privacy Policy explains how NexBorg AI ("NexBorg", "we", "us") collects, uses, stores, and protects information when you use Nex BuildO, our construction ERP platform, including the web portal, the mobile field app, and the AI features (collectively, the "Service"). NexBorg AI operates from 7, 6th Cross St, Balaji Nagar, Ekkatuthangal, Chennai, Tamil Nadu 600032, India.
1. Who this applies to
This policy covers two kinds of people: customers and their authorised users (the construction businesses, contractors, and staff who log in and operate Nex BuildO) and website visitors who browse our marketing site. Where a customer organisation loads data about its own employees, vendors, or projects, that organisation is the data controller and NexBorg AI acts as a data processor on its behalf.
2. Information we collect
Account & profile data
Names, work email addresses, phone numbers, organisation and role assignments, and authentication credentials used to create and secure your account.
Operational data you enter
Project records, job costs, budgets, purchase orders, vendors, daily logs, timecards, safety checklists, change orders, RFIs, invoices, payment ledger entries, and photos and files uploaded from the field or office. This is your business data; you control it.
Mobile & field data
When you use the Nex BuildO mobile app, we process the content of daily logs and photos you capture (including offline, syncing when a connection returns). With your permission, photos may include device-provided location/EXIF metadata so they can be tagged to the correct task and date.
AI interactions
When you use the AI assistant or AI support chat, we process the messages you send and the relevant workspace context needed to draft an action or answer a question. AI write-actions are limited to an allowlisted set of operations and are only executed after you explicitly approve them.
Usage & device data
Log data such as IP address, browser/device type, pages and features used, and timestamps, used to operate, secure, and improve the Service.
3. How we use information
- To provide, maintain, and secure the Service and sync data between the field and the office.
- To authenticate users, enforce role-based permissions, and keep audit trails.
- To power AI features — drafting actions you approve and answering support questions grounded in your workspace documentation.
- To provide customer support, send service and security notices, and process billing.
- To monitor performance, prevent fraud and abuse, and meet legal obligations.
We do not sell your data, and we do not use your operational or AI-interaction content to train third-party foundation models without your instruction.
4. AI and sub-processors
Some AI features rely on trusted third-party model providers that process the prompt and context needed to generate a draft or answer. These providers act under contract, process data only to return a response, and do not retain it to train their models on our behalf. A current list of sub-processors (hosting, model providers, email, error monitoring) is available on request to support@nexborg.com.
5. Storage, security & location
Operational data is stored in managed databases, and files (photos, documents) are stored in encrypted object storage (Cloudflare R2) accessed by your browser through short-lived signed URLs — files are not streamed through, or cached on, our application servers. Data is encrypted in transit (TLS) and at rest. For more detail, see our Security page.
6. Data retention
We retain your account and operational data for as long as your organisation maintains an active subscription, and for a limited period afterward to meet legal, accounting, and dispute-resolution needs. On verified request, we will delete or return customer data following account closure, subject to backups that expire on a rolling schedule.
7. Your rights
Depending on your jurisdiction, you may have the right to access, correct, export, or delete personal data, and to object to or restrict certain processing. Authorised users should contact their own organisation's administrator first; for direct requests, email support@nexborg.com and we will respond within a reasonable period.
8. Cookies
Our marketing site and app use strictly necessary cookies for authentication and session management, plus limited analytics to understand usage. You can control cookies through your browser settings.
9. Children
Nex BuildO is a business tool and is not directed to anyone under 18. We do not knowingly collect personal data from children.
10. Changes to this policy
We may update this policy as the Service evolves. Material changes will be notified through the Service or by email. The "Last updated" date above always reflects the current version.
